The terms ‘Silk Road Desire’ and associated product ranges ‘Premium Range’ and the ‘Ultimate Pet Duvet’; ‘our’, ‘we’ and ‘us’ when used in these Terms of Sale means Straight to Source Limited. The terms: ‘you’, ‘your’, yours’, ‘customer’, when used in these Terms of Sale means you, as a user of our website.

These Terms of Sale, along with the Website Terms of Use and our Privacy Policy, govern our relationship with you for your purchases of product from our website. This includes our responsibility to you and your commitment to us.

Shopping Online

Product Accuracy

We undertake every effort to ensure the photos of our products on our website represent the product you buy. We also work to ensure that the sizes, weights, colours and other product detail are accurate. We cannot take responsibility for slight variations in colour due to superior technology or settings on your computer display monitor.

Product Availability

We make every effort to ensure your product is available at the time that your order it, and it usually is, however all product listed on our website is subject to availability. Our inventory systems maintain stock levels automatically and through our order process your order is confirmed to you acknowledging that the product item you order is available. At times physical inventory levels may differ to automated computer inventory levels and you may discover your item is not available. We will notify you by email and/or phone of this occurrence, should it happen, within 2 working days and you will be given the option of ordering alternate product items. In this event of a stock item not been made available, it is your responsibility to reply to us within 5 working days of your request to adjust or cancel you order. In the event of a cancellation due to your product not being available, we will reimburse you any payments made within 14 days from the date of us sending you a cancellation notification unless we agree otherwise.

Order Process

All orders of items and product on the Silk Road Desire website are subject to acceptance by us. When you place an order, your order constitutes an offer to buy an item from us. After placing an order, you will receive an email confirmation from us acknowledging that we have received your order. Please note that this email does not mean you order has been automatically accepted. Acceptance of your order takes place when your order has been dispatched. You will receive another email stating that you order has been dispatched (Dispatch Confirmation). The contract between you and us will be formed when your Dispatch Confirmation has been sent.

We reserve the right to not accept an order in certain events such as; incorrect details between payment details and order details; authorization of payments cannot be obtained; stock non-availability; system malfunction or you do not meet the eligibility criteria as set out in these Terms of Sale.

We will not take responsibility for delays in shipment of your order should the details of your order be incomplete, miss-leading, invalid, inconsistent or in breach of our Terms of Sale.

Pricing

Products listed on our website are priced in Hong Kong dollars. Should you wish to view in an alternate currency, you are able to do so in the currency plugin provided. This currency converter is for reference only. The transactions will occur in Hong Kong dollars. We do not take responsibility of currency fluctuations within the time of order placement and shipment of your order. Nor do we take responsibility the currency exchange rate your bank or credit card provider uses in the conversion to Hong Kong dollars for transactions.

Delivery to locations on Hong Kong Island, Kowloon and the New Territories is free of charge, however locations on outlaying islands including Lantau Island and Lamma Island may attract an additional delivery charge of HK$100.

Whilst we work to ensure that the pricing information on our website is accurate at all times, please be sure to check your order confirmation for accurate pricing. In the event of an error, we will notify you and you can notify us for resolution.

Alterations to Orders

Under normal circumstances we do not allow alterations or changes to the order to be made once your order confirmation has been sent. Should you wish to make a change, please notify us immediately by calling +852 9400 2955 or +852 2194 4265 within 12 hours of you receiving your order confirmation, that is, before we have had a chance to pack and ship your order.

Payment Methods

Payment methods available can be made by PayPal and most major credit cards, cheque payment, COD and direct debit into our account. A Dispatch Confirmation will be sent advising your order shipment for orders received with cheque payment will occur only after funds have cleared. COD payments refer to cash only unless and alternative arrangement has been made in writing with us. A Dispatch Confirmation will be sent advising your order shipment for orders received with Direct Debit payment will occur only after funds have been received. Alternatively contact us directly by email (contact@silkroaddesire.com) for alternate payment methods. Payments by cheque or Direct Debit may result in a delay in shipment of your order. We do not take responsibility for delays caused by banks. For any bank to bank or direct debit payment, all bank charges and fees must be paid by you. If we receive an order requiring us to pay any bank charges and fees related to your order, it will result in a delay of shipment or cancellation of your order.

PayPal is a secure third party payment gateway provider and your payment card details are encrypted. We do not store any of your payment related information or credit card details on our website. Nor will we provide any personally identifiable payment-related detail to any third party without your prior consent.

Whilst we take reasonable care and effort to secure your payment details, we are not liable for any loss incurred to you should a third party procures unauthorized access to any data you provide to us when accessing or ordering from our website.

The default payment currency is Hong Kong dollars. Our currency converter is for your reference only. Should you wish to make payment in another currency, you will need to contact us separately.(contact@silkroaddesire.com) We do not take responsibility of currency fluctuations from the time you place your order to when payment is deducted from your payment choice or facility.

Delivery

We distribute our products from Hong Kong. Subject to stock availability, we offer a 48 hour delivery time (two working days), but it general we are able to deliver your order the following day once you have received your Dispatch Confirmation and payment approved for locations in Hong Kong excluding Outlaying Islands.

Delivery to locations on Hong Kong Island, Kowloon and the New Territories is free of charge, however locations on outlaying islands including Lantau Island and Lamma Island may attract an additional delivery charge of HK$100.

We are not able to send your order to a Post Office box. We can only deliver to a street address. The delivery address cannot be changed once the Dispatch Note has been sent to you. Should late changes be required or your order cannot be delivered due to incorrect or incomplete detail provided on your order, and the product is returned to us because of this, charges will be applied to the revised delivery instruction.

All deliveries will require a person to be made available to sign a Delivery or Courier Company Consignment Note. We will not take responsibility for delays incurred by no person at the delivery address or deliveries received and signed for by non-authorized persons. Be sure to contact us directly by email: contact@silkroaddesire.com to provide additional delivery instructions if required.

International Deliveries

International orders are welcome and accepted. You can advise your own method of transportation or we can ship to you using our shipping company. Should you be located outside of Hong Kong, please note the shipping charge that is generated on your order.

We will not take responsibility for damage incurred in shipment if you nominate your own shipping method or company.

Should you wish to use your own shipping method or company, we will sell your international orders on an ‘Ex-Works’ basis and as such, any customs clearance, VAT, GST, local charges, inspection charges, insurance will not be paid or be our responsibility.

Should you wish us to co-ordinate your international shipping, additional costs of shipping, customs clearance, VAT or GST (if required) and other shipping, including local market charges, will be advised prior to shipment. Your acceptance of these additional costs will be required prior to a Dispatch Note being sent to you by us.

For shipments exceeding the non-applicable quota for VAT or GST and exceeding 20kgs in weight, we will only sell on an ‘Ex-Works’ basis.

Payments for all international shipments are to be received in advance prior to shipment.

Storage

We can store your order at our storage facility free of charge for a period not exceeding 14 days. Should you require additional storage, we will advise cost to you by email.

Order Cancellation Policy

Orders cannot be cancelled once a Dispatch Confirmation is sent to you. Should you wish to cancel an order after you have placed an order, please contact us immediately by phone on +852 2194 4265 and email confirmation of your request to: contact@silkroaddesire.com

Please note that if payment has been received for the order you wish to cancel by the time we have received your order confirmation, but it is yet to be shipped, that it may take up to 30 days for us to reimburse your payment. Alternatively, you can use your payment for alternate product purchases.

Returns and Exchange Policy

If an item is damaged upon receipt then you can return the item for exchange for a replacement of the product or credit for a future purchase.
An item can only be accepted for a return for the following conditions:

• The item is unopened from its original packaging; meaning it has not been used
• We are notified of damage or incorrect shipment (wrong item sent) within 3 days
• That you are the original buyer of the item

Any item returned and exchanged can only be credited for the amount of the original item sent. We strongly advise to check the details in you Order Confirmation carefully.

Should you wish to return an item to us, please ensure you have packed it securely. Furthermore, please contact us by email: contact@silkroaddesire.com to receive instructions on where and how to send the item for return.

Damaged, Faulty or Incorrect Supply

Despite us checking every shipment thoroughly for damage, fault and accuracy, we acknowledge that mistakes can happen. We will do all possible actions to not further burden you with the frustration of supply mistakes.

For items that appear to be damaged, please ensure that this is noted with the carrier before signing for your shipment and contact us by phone (+852 2194 4265) and email: contact@silkroaddesire.com of the occurrence.

Should you open the package and find a fault such as incorrect size and weight of the product, again notify us immediately and we will make it our absolute priority to resolve the problem without cost and further burden to you.

Warranty

Our duvets when used in normal conditions can last as long as a decade. To ensure you get the longest life time from you product, please note our Use and Care instructions on this website.

We offer a 3 year guarantee for our Premium Range products and a 1 year guarantee on our Ultimate Pet range of products.
Note, that usage under normal conditions and compliance to our recommended Use and Care instructions are the conditions of our guarantee. Under normal conditions relates to the following:

• Items are used for their intended purpose as internal bedding product and should not be used for other purposes outside bedroom or living areas.
• Items cannot be used in an outdoor environment exposed to extreme elements such as rain, direct sunlight without protection, pollution, chemicals, vegetation and other foreign matter.
• Items should not be exposed to fluids and matter that will damage or mark linen or other bedding materials.
• For duvets, a high quality protective removable duvet cover should always be used.

General

Information on this website may contain technical inaccuracies or typographical errors. Changes and updates may be frequent including the Terms of Sale at any time. We reserve the right to correct errors found and to make changes as we deem necessary without notice. We also reserve the right to amend and remove or make changes to product photos and text information without notice.
